01 Agreement

Acceptance of these Terms

These Terms of Use (“Terms”) are a legal agreement between you and Cédric Jean René Maloux governing your access to and use of the Tally Rush iOS/iPadOS application, its online game services, website, accounts, leaderboards, and virtual currency (together, the “Service”).

By downloading, accessing, or using the Service, creating or using a player account, submitting an official result, entering Arena, or making an in-app purchase, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

If mandatory law gives you rights that conflict with these Terms, the mandatory law controls. No wording in these Terms is intended to waive a right that cannot legally be waived.

03 Eligibility

Age and guardian approval

You must be legally capable of agreeing to these Terms. If you are under the age of majority or otherwise cannot enter this agreement independently under the law where you live, your parent or legal guardian must review and accept these Terms for you and supervise your use of the Service.

You may not use Sign in with Apple or make in-app purchases unless you satisfy Apple’s age, family, and authorization rules. Parents and guardians are responsible, to the extent permitted by law, for purchases and Service use they authorize.

04 Service

The game and its modes

Tally Rush is a recreational mental-calculation and speed game. Current features may include:

Rush Mode, a free, local-first mode that may work offline;
Daily Challenge, with a limited official result for each UTC day and a rank snapshot or leaderboard placement;
Arena, where the displayed number of Tallies buys a defined set of ranked attempts under the displayed rules;
progression, XP, levels, mastery, missions, achievements, personal records, profiles, and global leaderboards; and
optional account connection, notifications, and consumable Tally purchases.

The exact level configuration, challenge variation, timing, scoring, Arena cost, number of attempts, reward rules, and availability may be adjusted prospectively to balance, secure, improve, or operate the game. The current terms shown in the app before you start an official mode form part of these Terms.

No intelligence, health, or educational assessment

Tally Rush scores, ranks, reaction times, XP, levels, and Tallies are entertainment mechanics. They are not an IQ test, intelligence score, medical device, health assessment, learning-disability assessment, educational qualification, or professional advice. Do not use them to make health, education, employment, financial, or other real-world decisions about anyone.

No gambling or real-world prizes

The Service does not provide real-money betting, player-to-player wagers, cash-out, deposits, loot-box purchases, or cash prizes. Arena participation and leaderboard placement do not create a right to money, property, or any real-world reward.

05 License

Your right to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to use Tally Rush for private, non-commercial entertainment on Apple-branded devices you own or control, as permitted by applicable App Store usage rules.

The app is licensed, not sold. Except where applicable law expressly permits it, you may not copy, distribute, rent, lease, sell, sublicense, publicly perform, modify, create derivative works from, reverse engineer, decompile, disassemble, derive source code from, or bypass technical protections of the Service.

Apple terms

Tally Rush is distributed through Apple’s App Store. Apple’s Standard End User License Agreement and applicable Apple Media Services terms also apply. These Terms supplement those terms for the Tally Rush account and online Service; they do not replace or conflict with Apple’s mandatory rules.

The agreement in these Terms is between you and the publisher, not Apple. Apple does not operate the Tally Rush game service and has no obligation to provide its maintenance or support. You must also comply with the terms of your device, network, and other third-party services used with the app.

06 Accounts

Guest accounts, Apple connection, and deletion

Tally Rush may create a pseudonymous guest account automatically so you can reach the game without a login wall. A guest account may be tied to the app installation and may not be recoverable if you delete the app, erase or replace the device, lose the session, or switch accounts.

Sign in with Apple can convert or connect eligible guest progress to a recoverable account and is required before purchases and certain paid online features. If the Apple identity already belongs to another Tally Rush player, the accounts are not silently merged. Choosing to switch may show the existing account while leaving the separate guest account and its progress unmerged.

You agree to:

keep your device, Apple Account, and authentication session secure;
provide a lawful display name and accurate optional profile choices;
not sell, transfer, share, or allow another person to misuse your account; and
notify us promptly if you suspect unauthorized account or purchase activity.

You can permanently delete your account in the app through Settings → Delete account and data. Deletion removes the active account, profile, progress, Tallies, scores, leaderboard entries, and associated player data, subject to limited backups and records that law requires us to retain. It cannot be undone. Any unused Tallies and unmerged guest progress are lost on deletion and are not refundable except where mandatory law requires otherwise.

07 Public play

Profiles and leaderboards

When you participate in an official ranking, your display name, public code, preset avatar, optional country, score, rank, accuracy or timing statistics, and attempt count may be visible to other players. Choose a display name you are comfortable making public and do not include private information.

You retain any rights you have in text you submit, such as your display name. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, moderate, and display that content only as reasonably needed to operate, secure, promote, and explain the Service. This license ends when the content is deleted from the active Service, subject to reasonable technical and legal retention.

We may reject, reset, or change a display name and remove or hide content that is unlawful, misleading, abusive, discriminatory, sexually explicit, infringing, impersonating, privacy-invasive, promotional, or otherwise unsuitable for a general-audience leaderboard.

08 Virtual currency

Tallies and Arena entries

“Tallies” are a closed, consumable, in-game virtual currency. They can be earned through specified progression milestones or acquired in App Store packs. Tallies buy participation in designated game features; they never buy easier puzzles, extra time, hints, score multipliers, favorable ranking, or other performance advantages.

Tallies:

have no cash, monetary, stored-value, or real-world property value;
cannot be transferred, sold, gifted, traded, withdrawn, or cashed out;
cannot be used for gambling, wagering, or a chance to win money;
may be used only within Tally Rush for the features shown in the app; and
are a limited contractual permission, not ownership of a digital asset.

Starting an Arena entry authorizes the displayed Tally deduction. Once the server has validly started the Arena entry or attempt, closing or backgrounding the app, failing to answer, losing connectivity, or not completing the attempt may result in a forfeit without returning the Tallies. If our authoritative records show the official session never started or a duplicate debit occurred because of a Service error, we will correct the ledger.

We may correct balances affected by fraud, chargebacks, refunds, duplicate delivery, technical error, unauthorized access, or a violation of these Terms. We will not arbitrarily confiscate lawfully purchased Tallies. Any prospective change to Tally costs or pack sizes does not change completed purchase records or create a cash redemption right.

09 App Store

Purchases, delivery, and refunds

Consumable Tally packs are purchased through Apple’s in-app purchase system. Apple displays the localized price, taxes, currency, and purchase confirmation and processes your payment method. A connected Sign in with Apple account is required so the purchase can be verified, credited once, and reconciled after interruption.

We credit Tallies only after Apple’s signed transaction is locally and server-verified. Delivery may remain pending during a network, App Store, or backend interruption. The app is designed to retry unfinished verified transactions. Do not buy the same pack again merely because delivery is pending; first reopen the app, check the balance, and contact support if needed.

Refunds and withdrawal rights

App Store payment, cancellation, and refund requests are handled through Apple and are subject to Apple’s terms and applicable mandatory consumer law. You can request support from Apple at reportaproblem.apple.com. If Apple refunds or reverses a purchase, the corresponding unspent Tallies may be removed and the balance corrected.

Calling a purchase “consumable” or saying that delivery is immediate does not remove any statutory right to a refund, withdrawal, remedy, or conformity of digital content. Those mandatory rights remain available where the law applies.

Except for those mandatory rights, an Apple-approved refund, or a verified Service delivery error, purchases and Tallies already consumed in Arena are final and cannot be exchanged for money or another item.

10 Conduct

Fair play and prohibited conduct

You must not, directly or through another person or tool:

use bots, scripts, macros, emulators, automation, or external answer tools for official play;
submit fabricated, replayed, altered, impossible, or another person’s gameplay events;
manipulate clocks, requests, scores, ranks, attempts, purchases, Tallies, or validation data;
exploit bugs, duplicate requests, race conditions, refunds, or chargebacks to gain value or ranking;
circumvent access controls, rate limits, security, account restrictions, or leaderboard exclusions;
probe, scrape, overload, disrupt, damage, or gain unauthorized access to the Service or another account;
impersonate another person or use unlawful, offensive, infringing, or privacy-invasive profile content;
use the Service for commercial resale, gambling, harassment, or unlawful activity; or
encourage, advertise, or provide instructions or tools for any prohibited conduct.

Official results are server-validated using puzzle reconstruction, timestamps, response patterns, idempotency controls, and other integrity checks. We may reject or remove results, correct balances, forfeit an affected entry, exclude an account from leaderboards, suspend online access, or terminate an account where we reasonably believe a rule was broken or the Service is at risk.

Where practical and consistent with security, you may contact support to contest an integrity decision. We may withhold details that would expose anti-cheat controls or facilitate abuse.

11 Reminders

Optional notifications

Notifications are optional. If you enable them, Tally Rush may send the reminder, Daily, Arena, reward, or purchase-status categories you select. Delivery timing is not guaranteed and may depend on your device, operating system, network, time zone, account state, Apple’s APNs service, and current game state.

You can change Tally Rush notification categories in the app and revoke system permission in iOS Settings. Do not rely on a notification as the only way to preserve a streak, enter a challenge, check a purchase, or take any time-sensitive action.

12 Operation

Availability, updates, and service changes

Local features may work offline, but accounts, official submissions, purchases, Arena, live leaderboards, synchronization, and notifications require compatible Apple services, a supported app/OS version, and network access.

We may maintain, patch, rebalance, update, add, remove, suspend, or discontinue features where reasonably needed for security, legal compliance, platform changes, technical limits, game balance, low usage, or product development. We do not promise that any feature, leaderboard, challenge, reward, configuration, or compatibility will be available forever.

Where a change materially affects paid digital content or mandatory consumer rights, we will provide the notice, remedy, or continued access required by applicable law. You may need to install updates to keep using online features safely.

Third-party services

The Service depends on third parties including Apple, internet/network providers, and Supabase infrastructure. Their services have separate terms and may experience outages, restrictions, or changes outside our control. Links to third-party websites are provided for convenience and do not make us responsible for their content, security, availability, or practices.

13 Ownership

Intellectual property

The Service—including its software, game rules and presentation, artwork, graphics, branding, text, sounds, interfaces, databases, and original content—is owned by the publisher or its licensors and protected by copyright, trademark, database, and other intellectual-property laws. All rights not expressly granted are reserved.

“Tally Rush,” its app icon, lightning/brain branding, and related visual identity may not be used to imply endorsement, create a confusing product, or market goods or services without prior written permission. Third-party components remain subject to their respective notices and licenses.

If you voluntarily send feedback or ideas, you grant us a perpetual, worldwide, non-exclusive, royalty-free right to use and incorporate that feedback without an obligation to compensate you, provided we do not publicly identify you without permission.

14 Enforcement

Suspension and termination

You may stop using the Service at any time and may delete your account as described above. We may limit, suspend, or terminate access, reject official submissions, remove leaderboard content, or disable an account if:

you materially or repeatedly breach these Terms;
your activity creates a security, fraud, legal, or operational risk;
payment is reversed, unauthorized, or fraudulently obtained;
we are required to act by Apple, a court, regulator, or applicable law; or
the relevant Service is discontinued.

Where appropriate, we may give notice and a reasonable opportunity to correct a breach. Immediate action may be taken for fraud, cheating, attacks, unlawful content, danger to others, or risks that cannot reasonably wait.

On termination, the license and right to use the affected Service end. Provisions that by their nature should survive—including ownership, virtual-currency restrictions, disclaimers, liability limits, governing law, and dispute terms—remain effective.

15 Warranty

Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” with all faults and without guarantees of any kind. We disclaim warranties and conditions not imposed by law, whether express, implied, or statutory, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, non-infringement, availability, and error-free or uninterrupted operation.

In particular, we do not warrant that:

the Service will always be available, compatible, secure, timely, or free of defects;
scores, ranks, notifications, sync, or third-party services will always be instant or error-free;
the Service will meet your expectations or produce any educational, cognitive, health, or competitive result;
local guest progress will survive app deletion, device loss, session loss, or account switching; or
all defects, data loss, outages, exploits, or unauthorized activity can be prevented or corrected.

You are responsible for maintaining appropriate device security, network access, backups or screenshots of information important to you, and safe use of the device. Take breaks and do not use the app where distraction could create danger.

Some jurisdictions do not allow certain warranty exclusions. In those places, these exclusions apply only to the extent permitted, and your mandatory statutory warranties and remedies remain unaffected.

16 Liability

Limits of responsibility and liability

Maximum lawful protection for the publisher

To the maximum extent permitted by applicable law, the publisher and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss or damage; loss of profit, revenue, business, opportunity, goodwill, enjoyment, anticipated savings, or data; device or network interruption; or the acts, content, outages, security failures, or decisions of Apple, Supabase, network operators, other users, or other third parties.

These exclusions apply regardless of legal theory and even if the possibility of loss was known, to the extent the law permits. They also apply to loss caused by your failure to secure an account or device, reliance on a notification or rank, unauthorized third-party conduct, internet failure, planned maintenance, or a feature change permitted by these Terms.

Where liability may lawfully be capped, the publisher’s total aggregate liability for all claims arising from the Service during any twelve-month period will not exceed the greater of EUR 50 and the amount you paid for Tally Rush through the App Store during the twelve months immediately before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for intentional or grossly negligent harm, fraud, death or personal injury where applicable, or breach of mandatory consumer, privacy, product-liability, digital-content, refund, or conformity rights.

The limitations in this section are an essential basis of the agreement and apply even if a limited remedy fails of its essential purpose, but only to the fullest extent allowed in your jurisdiction.

17 Disputes

Governing law and consumer complaints

These Terms and the relationship between you and the publisher are governed by the laws of the Czech Republic, excluding conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your habitual residence, and it does not restrict any court jurisdiction that mandatory consumer law makes available to you.

Please first send complaints to support@tallyrush.me so we can try to resolve the issue directly.

A consumer may also seek out-of-court resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce), the competent Czech alternative dispute resolution body for eligible consumer disputes. Its current filing instructions and conditions are available on its website. This does not limit either party’s right to use a competent court.

18 General

Changes and other legal terms

Changes to these Terms

We may update these Terms for new features, platform or provider changes, security, legal compliance, clarity, or changes in the Service. The current version will be posted at this URL with a new “Last updated” date. Material changes will receive reasonable advance or in-app notice where required. Changes will not retroactively remove accrued mandatory rights.

Severability and no waiver

If a provision is found invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. A failure or delay in enforcing a provision is not a waiver.

Assignment

You may not transfer these Terms or your account without our written consent. We may transfer the Service and these Terms as part of a genuine business transfer, reorganization, or sale, subject to applicable law and continued protection of your mandatory rights.

Entire agreement and language

These Terms, the Privacy Policy, the current rules displayed for an official mode, and applicable Apple terms form the agreement governing the Service. If a courtesy translation is provided, the English version controls to the extent allowed by law.

Export and sanctions compliance

You may not use or export the app in violation of applicable trade controls, embargoes, or sanctions, and you represent that you are not prohibited from using it under applicable law or App Store rules.
